Terms of Service — WPXFacets
Effective date: 04 June 2026 S.C. WebiXkit Solutions S.R.L., Constanța, Romania (“WebiXKit Solutions”, “we”, “us”)
1. Acceptance of Terms
By downloading, installing, or using the WPXFacets plugin or any associated subscription service (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
These Terms apply to all users, including free plan users, trial users, and paid subscribers.
2. Service Description
WPXFacets is a WooCommerce faceted search and filtering plugin. It operates in two modes depending on your plan:
- Core (Free Forever): Faceted filtering powered by WordPress native database queries. No Elasticsearch infrastructure is provisioned or required.
- Starter / Grow / Custom (Paid Subscriptions): Faceted filtering powered by a dedicated Elasticsearch instance provisioned and managed by WebiXKit Solutions on Hetzner infrastructure. Access requires an active paid subscription and a valid API key.
3. Free Plan (Core)
The Core plan is available at no cost, indefinitely, subject to these Terms. It provides access to basic facet types and WooCommerce filtering via WordPress native queries. No Elasticsearch server is provisioned for Core users.
WebiXKit Solutions reserves the right to modify the features included in the free plan at any time with reasonable advance notice.
4. Paid Subscriptions
Paid plans (Starter, Grow, Custom) include access to a managed Elasticsearch instance provisioned exclusively for your account. The subscription fee covers both the plugin license and the managed infrastructure.
Access to Elasticsearch features is gated by a per-account API key issued upon subscription activation. The API key is automatically deactivated upon subscription expiration, cancellation, or payment failure.
Upon API key deactivation, the plugin automatically falls back to WordPress native queries. Elasticsearch-powered filtering becomes unavailable until the subscription is reinstated and the API key reactivated.
5. Elasticsearch Infrastructure — Availability and Fallback Behavior
We operate Elasticsearch infrastructure on a best-effort basis. We do not guarantee any specific level of uptime, availability, or response time for the Elasticsearch service.
Automatic fallback: When the Elasticsearch server is unreachable or returns an error response (including HTTP 5xx errors), the WPXFacets plugin automatically falls back to WordPress native database queries. During a fallback period:
- Filter forms and facet UI elements remain visible and functional on your site.
- Search and filtering results are returned using WordPress native queries instead of Elasticsearch.
- Performance and result accuracy may be reduced, particularly on large product catalogs.
WebiXKit Solutions is not liable for any loss of revenue, reduced conversions, degraded performance, or any other damages arising from periods of Elasticsearch unavailability or fallback operation.
Planned maintenance that may cause temporary service interruption will be communicated in advance where feasible.
6. Data Indexing — Sync and Reindex
6.1 Initial Sync Requirement
Elasticsearch-powered filtering requires a complete initial sync of your product catalog. Until a successful initial sync has been completed and the Elasticsearch index has been created, ES-powered filtering is not available. Requests will fall back to WordPress native queries during this period.
6.2 Individual Product Sync
When a product is saved or updated in WooCommerce, it is automatically submitted to Elasticsearch, provided that an initial sync has already been performed and the Elasticsearch index exists. If the Elasticsearch server is unavailable at the time of save, the product update may not be reflected in the index. In such cases, re-saving the product or running a full reindex is required.
6.3 Full Reindex
A full reindex can be triggered from WPXFacets → Sync → Sync All. The full reindex process:
- Deletes the existing Elasticsearch index entirely.
- Creates a new index with the current mapping configuration.
- Submits all products to Elasticsearch in sequential batches of 300 items.
- Each batch is retried up to 3 times on failure. If a batch fails after 3 attempts, it is skipped and the process continues with the next batch.
During a full reindex, the existing index is unavailable. ES-powered filtering will fall back to WordPress native queries until the reindex completes.
6.4 Indexing Failures and Missing Products
Products that fail to reach the Elasticsearch index — due to network errors, server unavailability, or other causes — will not appear in Elasticsearch-filtered results. They will not be automatically retried outside of a full reindex.
To recover a missing product, you must either:
- Re-save the product individually in WooCommerce (triggers automatic re-submission), or
- Run a full reindex via Sync All.
WebiXKit Solutions is not liable for products missing from search results due to indexing failures. Monitoring sync status and triggering reindexes as needed is the responsibility of the subscriber.
7. Payment, Billing, and Renewal
Paid subscriptions are billed on a recurring monthly basis, in advance. Billing is processed through Stripe.
Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You authorize WebiXKit Solutions to charge the payment method on file for each renewal.
If a payment fails, access to Elasticsearch features is suspended. The API key is deactivated and the plugin falls back to WordPress native queries until payment is resolved.
We reserve the right to change subscription pricing. Material price changes will be communicated at least 30 days in advance. Continued use of the Service after the effective date of a price change constitutes acceptance.
No refunds are issued for partial billing periods or unused subscription time, except where required by applicable law.
8. Cancellation and Data Deletion
You may cancel your subscription at any time through your account dashboard or by contacting support. Cancellation takes effect at the end of the current billing period.
Upon cancellation or non-renewal:
- Your API key is deactivated and ES-powered features are disabled.
- The plugin automatically falls back to WordPress native queries.
- Your Elasticsearch index and associated infrastructure (VPS) are scheduled for deletion after a 7-day grace period from the date of deactivation.
After the grace period, all indexed data is permanently deleted. This data cannot be recovered. If you resubscribe after deletion, a full reindex is required.
9. Account Responsibilities
You are responsible for:
- Maintaining the security of your account credentials and API key.
- Ensuring your WooCommerce product data complies with applicable laws before indexing.
- Monitoring sync status and initiating reindexes when necessary.
- Notifying us promptly of any unauthorized use of your account or API key.
10. Prohibited Uses
You agree not to:
- Use the Service to index illegal, harmful, or infringing content.
- Attempt to reverse-engineer, resell, or redistribute the managed infrastructure or API credentials.
- Use the Service in a way that causes disproportionate load on shared infrastructure.
- Share your API key with sites or users not covered by your active subscription plan.
11. Right to Refuse or Terminate Service
WebiXKit Solutions reserves the right to refuse, suspend, or terminate access to the Service at its sole discretion, including for active paid subscriptions, if we determine that the subscriber’s website promotes or facilitates content or activities that we consider incompatible with our content standards, including but not limited to:
- sale or promotion of controlled substances, narcotics, or unregulated psychoactive products;
- adult or sexually explicit content;
- content promoting violence, hatred, or self-harm;
- gambling or predatory financial services;
- any content that, in our sole judgment, is harmful, deceptive, or deeply objectionable.
This list is illustrative, not exhaustive.
Termination initiated by WebiXKit Solutions under this section entitles you to a prorated refund of the unused portion of your current billing period. Refunds are calculated from the date of termination to the end of the prepaid period.
We will make reasonable efforts to notify you before termination unless the nature of the content requires immediate action.
12. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability. WebiXKit Solutions does not warrant that the Service will be error-free, that Elasticsearch results will be complete or accurate, or that the Service will meet your specific business requirements.
13. Limitation of Liability
To the maximum extent permitted by applicable law, WebiXKit Solutions and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or business interruption, arising from:
- Elasticsearch service unavailability or fallback operation;
- Indexing failures, incomplete indexes, or missing products in search results;
- Full reindex operations and associated periods of reduced filtering accuracy;
- Subscription interruption due to payment failure;
- Data deletion following subscription cancellation.
Our total liability for any claim arising under these Terms shall not exceed the subscription fees paid by you in the three (3) months preceding the claim.
14. Changes to Terms
We may update these Terms at any time. Material changes will be communicated via email or a notice on the website at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of Romania. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Constanța, Romania.
